The following terms and conditions refer to RAW Pop-up Ltd (“RAW Pop-up”) and its relationship with its clients and potential clients.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”).

Any new features or tools which are added to the website shall also be subject to these Terms. We reserve the right to update, change or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store and website is hosted on Squarespace. They provide us with the online e-commerce platform that allows us to sell our products and services to you. We may also release tickets via the Eventbrite platform.


GENERAL TERMS

  1. We reserve the right to refuse service to anyone for any reason at any time.

  2. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

  3. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

  4. We are not responsible if information made available on this site is not accurate, complete or current. Any reliance on the material on this site is at your own risk.

  5. Prices for our products are subject to change without notice.

  6. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

  7. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

  8. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy for any third-party websites.

  9. Your submission of personal information through the store is governed by our Privacy Policy. 

  10. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. 

  11. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice (including after you have submitted your order).

  12. In addition to other prohibitions as set forth in the Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

  13. You agree to indemnify, defend and hold harmless RAW Pop-up and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

  14. In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

  15. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

  16. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

  17. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

  18. The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

  19. These Terms and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).

  20. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

  21. RAW Pop-up shall not be liable or deemed to be in breach of contract by reason of any delay in performing, or failure to perform, any of its obligations if the delay or failure was due to any cause beyond its reasonable control.

  22. These conditions and all other express terms of the contract shall be governed and constructed in accordance with the laws of Scotland and you hereby submit to the non-exclusive jurisdiction of the Scotland courts.


    EXPERIENCES

  23. RAW Pop-up does not guarantee the quality, level of expertise or any other such attribute relating to the content of the experiences and the teaching of anything within the experience. Clients follow the teachings at their own risk.

  24. Clients are expected to make their own travel arrangements to the location of any experience and at their own cost unless otherwise explicity stated in the event description or details. 

  25. RAW Pop-up reserves the right to cancel or delay any experience due to circumstances out of their control, including but not limited to, severe weather conditions.

  26. RAW Pop-up reserves the right to cancel any experience due to insufficient number of participants.

  27. The content may vary between occurances of the same experience and are subject to change without notice. Produce is seasonal where possible and is therefore changing frequently. 

  28. RAW Pop-up uses wild game which may contain shot. Clients working with game on any of our experiences do so at their own risk.

  29. You must, at all times, comply to the rules and regulations set out by RAW Pop-up. RAW Pop-up reserves the right to remove you, the client, from an experience if the rules and regulations are not followed.

  30. Experiences often take place outdoors and in environments with basic conditions. It is the clients responsibility to dress accordingly for such conditions including but not limited to warm and weatherproof clothing. 

  31. Experiences may involve activities such as butchery and fishmongery. Dealing with whole or butchered raw animals. This may be disturbing to some people and anyone who attends an experience does so willingly with the knowledge they may see and be involved in the preparation of such products.

  32. RAW Pop-up has legal and regulatory obligations to provide a duty-of-care to all that participate in any of our experiences. All reasonable steps to provide the level of care and assurances of safety that are appropriate are taken. You should though be aware that there will always be certain risks that are inherent to experiences. It is not possible to eliminate these risks without destroying the character and quality of the experience.

  33. Clients may be subject to risks including but not limited to; working with live fire; using share knives and other utensils; physical exertion; in outdoor environments with varying weather conditions; dealing with raw meat/fish and other produce; moving across uneven/various terrain; slips and trips

    PAYMENTS, REFUNDS AND CANCELLATIONS

  34. Payments for any of our products or services are final and subject to our refund policies set out in this section.

  35. Payments are accepted through the Squarespace payment platform or Evenbrite subject to availability. 

  36. Certain shorter experiences may allow payments to be made in person via card reader subject to availability.

  37. Payments must be made prior to receiving any goods or services from RAW Pop-up. Payment terms and refunds may vary depending on the length of an experience.

  38. Partial refunds of 50% or credit towards other experiences are available for cancellations made on or before 1 week before the start date of an experience lasting no more than 1 day. 

  39. Partial refunds of 30% or credit towards other experiences are available for cancellations made on or before 3 weeks before the start date of an experience lasting longer than 1 day.

  40. Full refunds or credit towards other experiences are available for any cancellations by RAW Pop-up.
